Terms and Conditions for Web App Monitoring

1. Authorization to Monitor
By using the services provided by Footprint Systems ("Footprint"), you grant Footprint explicit authorization to access and monitor the web applications ("Web App") specified by you. You affirm that you have the legal right and authority to grant such access for the purposes of monitoring and analysis as outlined in this agreement.
2. Legal Rights and Responsibilities
Footprint Systems will perform monitoring services solely on the Web App URLs and related digital assets that you have registered with our service. The monitoring will include checking the operational status and rendering correctness of the Web App to ensure performance as expected.
3. Scope of Monitoring
You confirm that you possess the necessary legal rights to permit monitoring of the Web App and that by granting Footprint Systems access, you are not violating any laws or regulations, nor infringing on the rights of third parties. It is your responsibility to ensure that the use of Footprint Systems services is in compliance with all applicable laws and contractual obligations.
4. Discretion of Service
Footprint Systems reserves the right to decide which Web Apps to monitor and may refuse service for any Web App at its sole discretion. Reasons for such decisions may include, but are not limited to, security concerns, potential legal issues, or the technical infeasibility of monitoring the specified Web App.
5. User Understanding
You understand and agree that the decision to monitor any Web App is at the sole discretion of Footprint Systems. You acknowledge that Footprint Systems may not be able to monitor every Web App and that decisions regarding the allocation of monitoring resources are determined by operational priorities and constraints.
6. Limitation of Liability
Footprint Systems is not liable for any damages or losses resulting from the failure to detect issues with your Web App, the accuracy of monitoring, or the actions taken based on the findings of our monitoring. Our service is provided "as is" and without warranties of any kind, either express or implied.
7. Interaction Liability
You acknowledge and agree that Footprint Systems employs automated systems ("bots") to monitor your Web App as part of its service. Footprint Systems is not responsible for any disruptions, changes, or impacts that these bots may inadvertently cause to your Web App during the monitoring process. It is your responsibility to ensure that your Web App can safely accommodate such interactions without detrimental effects.
8. Duration of Free Monitoring
The free monitoring service provided by Footprint Systems is valid for a period of 30 days from the date of activation. Upon the expiration of the free monitoring period, continued service will require a subscription or other payment agreement as specified by Footprint Systems. Please refer to our subscription plans for further details on extending your service.
9. Changes to Terms
Footprint Systems reserves the right to modify these terms and conditions at any time. Continued use of our services after such changes will constitute your acceptance of the new terms.
10. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.
